Gregory Meeder and Aaron Crews | June 15, 2026
Construction attorney Gregory Meeder and innovation attorney Aaron Crews wrote an article published in Commercial Construction & Renovation Magazine about the ways artificial intelligence (AI) can benefit construction mediation. As the attorneys explain, mediation is an optimal route for resolving construction disputes, as these matters involve technical complexity, compressed schemes and high financial stakes that quickly sink a project and causes losses for all parties. AI can assist with mediation by helping each side quickly identify the areas of disagreement and work more efficiently toward a compromise or solution. To illustrate the power of this technology, Gregory and Aaron describe an example in which a mediator deployed AI-assisted “Move the Needle” Clarification Questions to break through a large-scale construction dispute that had been at a stalemate for more than year. They then go on to explain the differences between analytic AI and large language models (LLMs), along with important guardrails such as being transparent about the use of AI and reviewing AI-generated outputs. The article concludes by summarizing how AI-assisted workflows align with mediation’s collaborative model and outlining what a well-designed AI-assisted mediation process looks like in practice.
